The First Section of the Provincial Court of Las Palmas will try next week in Arrecife a man accused of sexually assaulting his partner's daughter on an ongoing basis, when the minor was between 10 and 12 years old. The Prosecutor's Office is asking for 15 years in prison for him, in addition to restraining orders from the victim and other children. It also requests that he compensate the mother, as legal representative, with the amount of 75,000 euros, “for the moral damages suffered by the victim.”
According to the medical reports provided in the case, the girl suffers from “depressive-type symptoms, somatizations, anxiety symptoms, low self-esteem, personal adaptation problems and a tendency to school problems,” which, according to the Prosecutor's Office, demonstrates “the existence of sequelae and psychological damage” due to what happened.
The indictment places the beginning of the events in September 2015, noting that they continued until August 2018. During that period, the Public Prosecutor's Office maintains that the accused, “moved by his sexual attraction towards minors, with the intention of maintaining sexual relations and thus satisfying his libidinous spirit, had numerous sexual encounters” with the girl, “taking advantage of the relationship of trust existing between them, as the defendant was the sentimental partner of the minor's mother and because both lived in the same common home.”
In this way, he initiated “full sexual relations not consented to by the minor,” according to the accusation, “taking advantage” of the moments when the mother was out of the house. “He forced the minor to maintain said sexual relations, under the threat that he was going to put her in a boarding school, that he was going to make her life impossible and that he was going to slit her head open,” the Public Prosecutor's Office points out.
In his qualification brief, he considers him the perpetrator of a continued crime of sexual assault on a minor under 16 years of age and, in addition to the 15-year prison sentence, asks that he be prohibited from approaching the minor at a distance of less than 500 meters or communicating with her for 25 years.
He also requests a special disqualification penalty for any profession or trade, whether paid or not, that involves regular and direct contact with minors for 20 years.
Furthermore, once the sentence has been served, he requests that the supervised release measure be imposed, extending the restraining order for the minor and her disqualification for any activity related to minors for 10 years, and that he be obliged to participate in sexual education programs for pedophiles.
