The Prosecutor's Office Asks for Eight Years in Prison for the Accused of Raping a Woman in a Car in Yaiza

The trial will be held next week in Arrecife, before the First Section of the Provincial Court

The Provincial Court of Las Palmas will try next week a man accused of raping a woman in the municipality of Yaiza, taking advantage of the fact that she was "in a state of drowsiness" due to alcohol consumption.

The Prosecutor's Office is asking for an eight-year prison sentence for a crime of sexual abuse, while the victim has not claimed compensation.

The events occurred almost four years ago, on June 10, 2018, at around 6:40 a.m. According to the indictment, the defendant was in his car with the woman, who was asleep in the back of the vehicle.

"Upon observing that the victim was in a state of drowsiness due to the previous intake, that same morning, of alcoholic beverages, he stopped the vehicle and entered the back seat, where she was lying down," the Prosecutor's Office states.

Afterwards, it adds that "after verifying her state of lethargy, with her reaction faculties notably annulled," he placed himself on top of her, took off her clothes and penetrated her vaginally, "stopping his action at the moment he realized that the victim was minimally regaining consciousness."

In addition to eight years in prison, the Prosecutor's Office is asking that the defendant be prohibited from approaching the victim within 500 meters or communicating with her for ten years; and that once the prison sentence has been served, he be imposed another nine years of supervised release, participating in sexual education courses.
