The defendants who assaulted the house of José Antonio Perera, who died shortly after, are on trial

The Prosecutor's Office requests prison sentences of between 20 and 27 years for the seven defendants for the crimes of murder, robbery with violence and possession of prohibited weapons.

The Sixth Section of the Provincial Court of Las Palmas will try, starting on September 11 in Arrecife, seven people accused of the crimes of attempted murder, robbery with violence in an inhabited house and possession of prohibited weapons for the death of the resident of San Bartolomé José Antonio Perera de León, who was assaulted in his home in La Florida in 2016. For the accused, the Public Prosecutor's Office requests from 20 to 27 years in prison.

The events date back to 8:30 a.m. on January 18, 2016. According to the Prosecutor's Office's indictment, the seven defendants allegedly posed as members of the State Security Forces and entered a house in San Bartolomé, with its two owners inside.

Before the robbery, one of the accused dressed up with a goatee and a fake mustache to avoid being recognized. At the moment they entered the house, they tied the hands of both owners and began to ask them where the safe was. To harass them, they would have begun to "hit him all over the body and apply electric shocks", according to the Public Ministry.

As a result, they caused various injuries to one of the residents. Among them, and according to the Public Prosecutor's Office, they generated a severe traumatic brain injury with a displaced comminuted fracture and a sinking in the right temporal region, fracture in the eyes, in the left humerus, ribs and lumbar and dorsal vertebrae.

They also generated "multiple" injuries to the body, a hematoma on the tongue, as well as a lung effusion. All of this meant a serious deterioration of vital functions, which is why surgical intervention was necessary. To which must be added the electric shocks that the affected person received in the external area of the genitals.

This caused a high vital risk for the affected person, who also saw his vital organs damaged. After allegedly carrying out the robbery and seizing several watches and jewels, the thieves fled in a vehicle owned by the attacked person.

Two months later, the man, a carpenter from San Bartolomé, died during the recovery period. The cause of death was a massive bilateral acute pulmonary thromboembolism. As revealed by the forensic medical report, this thrombus evolved between 25 and 60 days before, according to the Public Ministry, in the period between the assault and the immobilization of the victim due to the injuries.

For this reason, the seven defendants face the alleged authorship of a crime of attempted murder, as well as robbery with violence in an inhabited house with illegal detention. One of them, the one who used a goatee and a mustache, also with the aggravating circumstance of having gone disguised.

During the investigation it was discovered that two of the accused, N.D.P. and S.V.R. had a weapon prohibited to individuals by the Regulations. For this reason, they also face the alleged crime of illegal possession of weapons. In addition, N.D.P. was a repeat offender in the crimes of robbery with violence in an inhabited house, as well as A.E.G. was a repeat offender in that and in the crime of illegal detention.

Penalties requested by the Prosecutor's Office

Among the accused, six of them had criminal records, but only in two of the cases can it be computed as repeat offenders.

For the accused A N.D.P.P. and A S.V.R.B, the Public Prosecutor's Office requests 27 years less one day of prison. Specifically, the Prosecutor's Office requests 15 years less one day of prison, with an accessory penalty of absolute disqualification, for the crime of attempted murder; nine years of prison and special disqualification for the crime of robbery with violence in an inhabited house and illegal detention; as well as three years for the crime of possession of prohibited weapons.

Meanwhile, for the accused A A.E.G.G, A J.M.B.O, A S.V.R.B requests a total of 24 years less one day in prison: 15 years less one day for the crime of attempted murder and nine years for the crime of robbery with violence in an inhabited house.

For the rest, J.A.D.R., N.M.G.A. and A.D.D. requests 20 years in prison: 13 less one day for a crime of attempted murder and seven years for robbery with violence in an inhabited house, as well as the payment of court costs.

In addition to the prison sentences, the Public Prosecutor's Office has requested, as fulfillment of civil liability, that the seven defendants indemnify "jointly and severally" the deceased's sentimental partner, as well as his minor daughter, "in the amount of 120,000 euros."
