The Sixth Section of the Provincial Court of Las Palmas has issued several resolutions resolving various appeals filed by the people initially investigated in the so-called "San Ginés Case" (the former president of the Cabildo of Lanzarote, Pedro San Ginés (CC), the lawyer and close friend of the latter, Ignacio Calatayud, the wife of the latter, Juana María Fernández and the company "Adelfas 24 SL") against the resolutions of the Court of Instruction No. 2 of Arrecife that agreed to "the preventive embargo and absolute prohibition of carrying out any acts of disposition or encumbrance of real estate owned by them and the preventive embargo and absolute prohibition of carrying out any acts of disposition or encumbrance of movable property owned by them".
In the orders that have been recently notified, the magistrates of the Sixth Section of the Court have "partially upheld" the appeals of the investigated "in the sole sense of lifting the preventive embargo and preventive blocking of all balances of banking products", because said Court considers that the possible economic responsibilities derived from the facts that are being investigated "are sufficiently guaranteed with the embargo of the real estate and furniture of the accused", since the embargo is maintained and the prohibition to dispose of them.
The Court insists in all its resolutions that "we do not doubt, as we have said in other resolutions of this same date, the existence of indications that support the investigation", warning that in this phase of the investigation "full proof of authorship or a definitive legal qualification of the conduct is not required, but only the existence of rational indications of the commission of a criminal action", which the Court also appreciates in this case, the measures adopted by the Court being destined to ensure the economic responsibilities that could derive from the allegedly criminal acts that are being investigated in this case.
As will be recalled, the case investigates the enormous amounts of money that Ignacio Calatayud pocketed thanks to his friend Pedro San Ginés, at the time when he was president of the Cabildo of Lanzarote. As has been proven in the investigation, the amount that Calatayud received for different concepts is close to two million euros, including the court costs charged without the knowledge of the public water company (INALSA) and the Water Consortium of Lanzarote.
