A minor has reaffirmed this Wednesday in the Provincial Court of Las Palmas the sexual aggressions she suffered from her father during the summer of 2017 in a family home in Lanzarote, events that she initially confessed in her personal diary. The discovery of these writings by her mother was what motivated the complaint against her ex-partner. The Prosecutor's Office and the private prosecution request a sentence of 12 years in prison for the accused, Jerónimo R. D., for a continued crime of sexual assault on a minor under 10 years of age, in addition to compensation of 50,000 euros for moral damages. The accused strongly denies the facts, arguing that the minor was "fanciful" and liked to write "macabre" stories.
During the trial, the victim, now of legal age, recounted having suffered more than seven aggressions, in addition to verbal and physical abuse. She described how her father insulted and assaulted her, and how she felt incommunicado and threatened, unable to tell her grandparents for fear of retaliation. She stated that the accused waited to be alone or for her grandparents to sleep to enter her room and touch her, repeatedly forcing her to have full sexual relations.
The police investigation considered the minor's statement "forceful", proceeding to the arrest of the accused. Although the forensic experts validated her statement, they could not establish the credibility of the account due to the passage of time and detected a possible exaggeration of symptoms. The defense, for its part, requests free acquittal, considering that the evidence presented is not sufficient to invalidate the presumption of innocence, insisting on the version that the accused was never alone with the minor in the home.
