Juan Francisco Rosa will be back in the dock in 2025

The Lanzarote businessman will be judged together with two of his children and other relatives for corporate crimes against his partner in the Hotel Fariones

The First Section of the Provincial Court of Las Palmas will judge in 2025 the Lanzarote businessman Juan Francisco Rosa, two of his children and other members of his family for the corporate crimes of misappropriation and document forgery. According to La Voz, Rosa will be back in the dock on January 20, 21, 22, 23, 24, 27, 28, 29, 30 and 31, as well as on February 3, 4, 5 and 6, 2025.

The appointment was issued last Friday, November 10 by the lawyer of the Administration of Justice. After the Court of Instruction number 2 of Arrecife, with Jerónimo Alonso as head, ordered on November 23, 2021 the opening of oral trial.

The aforementioned case began in 2017 after a complaint filed by the businessman's partners in the Fariones hotel, García Bravo e Hijos SL. According to the prosecution's indictment, Juan Francisco Rosa acted as the material author of the investigated crimes, while the other five defendants "followed his instructions."

Therefore, the Public Prosecutor's Office requests for Juan Francisco Rosa a penalty of four years in prison considering him the material author of two continued corporate crimes and a continued crime of forgery in a commercial document. Likewise, for the rest of the defendants he asks for two years in prison.

Meanwhile, the private prosecution, exercised by García Bravo e Hijos SL, adds the crime of misappropriation or, alternatively, that of unfair administration and asks for eleven years in prison for all the defendants.

The Public Prosecutor's Office defends that between, at least, 2004 and 2016, the defendants allegedly granted loans - undocumented - in favor of companies linked to the defendants and unrelated to the minority partner and to the company's own activity." These loans ranged between 486,425.04 euros (2008) and 6,348,610.4 euros (2016).

When he requested the start of the oral trial, Judge Jerónimo Alonso demanded from Juan Francisco Rosa and his two children Raquel and Andrés Rosa Caraballo a bail of 57 million euros. In addition, the defendants Anselmo Rosa Perdomo and Rosa María Rosa Martín had to deposit almost 30 million euros each.

In the aforementioned writing, the Public Prosecutor's Office maintains that the defendants, "members of the same family, previously agreed and acting jointly following the instructions" of Juan Francisco Rosa, used the positions held by each one in different periods and acted "with a clear intention to favor their personal interests, family and patrimonial and aware of the economic damage caused to the company and the minority partner of the same, the commercial entity García Bravo, S.L."
