The First Section of the Provincial Court has sentenced the accused of abusing two minors in Arrecife to 17 years and 10 months in prison.
Likewise, after serving the prison sentence, he has been imposed a supervised release measure for eight years. In addition, M.G.M. must compensate the victims with a total of 100,000 euros and may not approach them for 22 years.
The convicted man had a sentimental relationship with the great-aunt of the girls, with whom he lived, and the minors "used to go to the home practically from birth" due to the "good relationship between both families", as highlighted in the sentence.
As a result, M.G.M and his partner "spent time" with the girls "as if they were their granddaughters", the minors even "staying overnight in the aforementioned home many weekends from Friday to Saturday." A dedication that, according to reports, "increased when the mother, between 2012 and 2013, suffered from an illness" and "the father, due to his work schedule and the attention his wife needed, could not spend much time with his daughters either."
According to the court ruling, "the accused took advantage of the aforementioned relationship and used his role as grandfather to approach the minors and attract them to him." In this regard, it is highlighted that he also "let them use his tablet so that they could play in his bedroom bed, thus generally having a private space at night to be alone with the girls."
First he abused the older one and years later the younger one
His actions and intimate relationship with the girls "projected it separately", so that he first began to abuse the older one. When she "was six or seven years old" he made the "first touches" reaching to penetrate her in later encounters "when the minor had already turned 10 years old." He also "forced the minor on other occasions to masturbate him and perform some fellatio," actions that "were repeated and prolonged until 2016," when the minor "was already about twelve years old."
After that last date, according to the sentence, the accused began to abuse the younger sister, who at that time also "was about six or seven years old." These abuses consisted of touching and lasted "at least until December 22, 2018."
The accused denied the facts during the trial
The trial was held on September 28 in Arrecife and, during the same, the accused denied the facts. However, the First Section of the Provincial Court considers the statements of the minors as well as the reports prepared by the forensic psychologists to each of them as evidence of charge.
Therefore, M.G.M is sentenced to five years and ten months in prison for a "basic" sexual abuse crime and twelve years in prison for a sexual abuse crime with carnal access, with the aggravating circumstance of "abuse of superiority" occurring in both cases. Regarding compensation, he must pay 40,000 euros to one of the minors and 60,000 euros to the other "for the moral damages caused."
It should be remembered that, during the trial, the court did not allow the media to take images of the accused to protect the victims and their family environment.
