The Sixth Section of the Provincial Court of Las Palmas will host the trial next week against M.R.M., who has no prior criminal record, for whom the Public Prosecutor's Office is seeking a sentence of eight years in prison for an alleged sexual assault with penetration that occurred in Playa Blanca.
The facts, according to the Public Prosecutor's written statement, occurred between 8:00 PM and 8:30 PM on September 29, 2022, at the pool bar of the Hotel Relaxia Club Lanza Sur. The accused, who was working at the location, allegedly approached a tourist staying at the establishment as she **was heading to the restrooms**.
The document states that M.R.M., "with the intention of satisfying his sexual desires and against the tourist's will," grabbed her forcefully, took her into one of the bathrooms, and closed the door. From that moment on, the defendant allegedly subdued her by force, grabbing her hair, covering her mouth, and pulling down her underwear to insert his fingers into her vagina and bite her buttocks.
Afterward, the aggressor allegedly forced the victim to lower her head to the level of the toilet to penetrate her vaginally and, after turning her, allegedly forced her to perform fellatio, all while grabbing her nipples and breasts tightly.
As a consequence of the assault, **the victim suffered injuries** in the right subscapular region, on the posterior side of the right arm, on the left breast, and on both buttocks, as recognized by the forensic doctor. These injuries required initial medical attention and took 10 days to heal, three of which prevented them from carrying out their usual activities.
The Public Prosecutor's Office classifies the events as a sexual assault with penetration and requests, in addition to eight years in prison, special disqualification from the right to passive suffrage for the duration of the sentence, prohibition of approaching or communicating with the victim and of returning to the scene of the events or going to her home for a period of ten years, a measure of supervised release for six years and special disqualification from any profession, trade or activity that involves regular and direct contact with minors for fifteen years.
In terms of civil liability, the Prosecutor's Office claims that the defendant compensate the victim with 425 euros for injuries and 1,500 euros for moral damages suffered, amounts that will accrue legal interest increased by two points
