It must be taken into account that Spanish companies still do not have the obligations regarding equality corresponding to the current regulations such as RD 901/2020, of 13 regarding equality plans, or RD 902/2020 of October 13 regarding pay audits. It is worrying that since the regulations came into force more than three years have passed and many still do not know their obligations, and that the sanctions range from 7,500 euros to more than 225,000 euros.

As a company, what am I obligated to do?

Below, we show the obligations that companies currently have in our country regarding equality, all of which depends on the threshold of workers that the company has, on the one hand, we have the obligations of all companies regardless of the number of workers they have, which are the protocols for prevention and action against sexual harassment and harassment based on sex and other behaviors contrary to sexual freedom and moral integrity in the workplace, after the entry into force of the law of yes only is yes (Organic Law 10/2022, of September 6, on comprehensive guarantee of sexual freedom) and training to all its staff, they must also have a pay register.

On the other hand, companies that have 50 or more workers, in addition to these obligations, must have an equality plan, a pay audit, and companies with more than fifty workers must have, within twelve months from the entry into force of this law, a planned set of measures and resources to achieve real and effective equality for LGTBI people, which includes an action protocol for the care of harassment or violence against LGTBI people.

To this end, the measures will be agreed through collective bargaining and agreed with the legal representation of the workers. The content and scope of these measures will be developed in regulations.
