The Arrecife City Council has sent this Monday afternoon a complete copy of the ruling of the Contentious-Administrative Court number 3 of Las Palmas and states that "the PSOE has manipulated the court ruling, and has wanted to make the public believe that the mayor of the city of Arrecife has been condemned by the justice to hand over the Ginory file to the socialist group in this City Council".
The final ruling of last August "exposed the PSOE and its strategy of making noise with this issue, in which the mayor Yonathan de León has not intervened at all".
From the City Council they affirm that "contrary to what was spread by the socialist councilor Cristina Duque, the judge has rejected the claims of the PSOE and ruled, last August, that the mayor has not violated the fundamental rights of that socialist group".
"On the contrary, the ruling makes it very clear that Yonathan de León at no time opposed access to the file. Moreover, the judge rules that the mayor's resolutions allowed the socialists to directly access the aforementioned file in the secretariat," they affirm.
Yonathan de León has sent to the media the complete copy of this ruling, as well as the previous order, "with a clear example of public transfer to demonstrate that Cristina Duque, and the PSOE of Arrecife, manipulate the meaning of the court ruling to make the public see a content of the court ruling very different from that resolved by the justice".
For the mayor, this new line that the PSOE has crossed "reveals the mud in which the socialist councilors are accustomed to moving, who, even without being supported by the justice, manipulate the content of the judicial rulings that are adverse to Pedro Sánchez's party in Lanzarote".
The Arrecife City Council recalls that the Justice has already ruled, in a judicial order of last May "that the general interest, defended by the Arrecife City Council, must prevail" over the legitimate intentions of the PSOE to know the resolutions on the settlement of the compensation for the expropriation of the Ginory plot, a procedure that began more than 25 years ago, with the PSOE governing in the Arrecife City Council".
The presiding judge of the Contentious-Administrative Court number 6 of Las Palmas, issued on May 3, 2024, a judicial order where she gives the reason to the Arrecife City Council, against the "precautionary" measures requested by the spokesperson of the PSOE in Arrecife, Alfredo Mendoza, regarding access to information on the settlement of the legal interests to which the Arrecife City Council was condemned "for the inaction of the former mayor Eva de Anta, of the PSOE, on the payment of compensation for the expropriation of the Ginory plot", according to the consistory.
And now, "with the final ruling of last August -misinterpreted by the PSOE in its statement to the media- reveals that the mayor of Arrecife never opposed the access by the aforementioned councilors of the PSOE to this file. And what is more, the judge details in her ruling that could not be appealed by the PSOE, that the fundamental rights were not violated. And the judicial lawsuit presented by the PSOE was poorly processed, and with a serious error of interpretation of the fundamental rights", they declare.
The PSOE, recalls the City Council, "already muddied in last June, coinciding with the European elections, the municipal policy with the partisan use of that Ginory file".
"Despite the existence of a judicial order, which the PSOE knew, this left-wing political formation wanted to make the public believe that the mayor of Arrecife Yonathan de León obstructs access to this file. The reality, as it is accredited, is that the Legal Advice of the Arrecife City Council issued three reports where it pointed out that the measure requested by the PSOE, through its councilors Alfredo Mendoza, Cristina Duque and Roy González, could affect a process that still must be decided by the justice regarding the amount of the legal interests, and the aggravated penalty of two more points, for the inaction of Eva de Anta as mayor of Arrecife, having Cristina Duque as advisor, in whose documentation on record is the "mediation of the councilor Duque in this procedure".
The justice is resolving only in this Ginory file the amount of the legal interests, after the City Council was condemned, in the stage of Eva de Anta (PSOE) to the payment of 5% of legal interests, aggravated in two points by the inaction.
The mayor of the city, Yonathan de León, has recalled that "that payment for the Ginory plot had the support and favorable vote, in the past term, of Alfredo Mendoza, Roy González and Cristina Duque, the same ones who have been submitting requests to access a file that they know, supported and voted favorably".
