It bases its resolution on previous cases registered nationally during other electoral periods, where freedom of expression prevails if it concerns personal profiles and not those created in the name of public institutions.

The Electoral Board of Arrecife has rejected that a publication by the mayor of Arrecife, Yonathan de León (Popular Party), on social media, where he disseminated the progress of the 201 social housing units under construction in Maneje, was against electoral law.

The PSOE had reported the PP to the District Electoral Board for the use of social housing under construction in Maneje for propaganda purposes after the election announcement.

In a complaint filed on October 23, the socialist spokesperson in the Arrecife City Council, Cristina Duque, stated that the mayor of Lanzarote's capital, Yonathan de León, disseminated "a management achievement" on social media, despite the fact that the law prohibits the public dissemination of institutional achievements from the announcement of elections until they are held.

In its resolution, dated October 28, the Electoral Board states that the dissemination on Facebook of an image showing the progress of the construction of 201 social housing units in Maneje and the announcement of another 201 housing units pending construction in the same area, does not violate the prohibition of "carrying out a campaign of achievements," as set out in Article 50.2 of the Electoral Law.

The Electoral Board bases its resolution on previous cases registered nationally during other electoral periods, where freedom of expression prevails over this electoral law, when publications are made from private or personal accounts. In this instance, De León used his personal Facebook account, which he uses to disseminate other content as mayor, but not the City Council's.
