The PSOE demands the execution of all pending measures to guarantee the safety of plot 216 of Costa Teguise

The socialists recall that the execution orders in effect since 2016 contemplate coercive fines, subsidiary execution, and even criminal proceedings in case of non-compliance.

The Socialist Party (PSOE) of Teguise has spoken out decisively during the plenary session held this Wednesday regarding the problematic situation of the urbanistic skeleton of plot 216 of Costa Teguise, an illegal structure that has been a blight on the town of Costa Teguise and its more than 9,000 residents for two decades.

During the debate, the socialists demanded that the local government, made up of Coalición Canaria (CC), Partido Popular (PP), and the former councilor from Vox, fully enforce the execution orders issued for this space and adopt all necessary measures to ensure its proper fencing and prevent uncontrolled access.

“It is not just about requiring the property owner, but about them complying with and carrying out what is established in the various execution orders issued by the City Council, in files dating from 2016, 2020, and 2021, from which repeated requirements have been derived, the last one on May 25th,” states Marcos Bergaz.

The socialist leader recalls that a technical report from 2016 already pointed out “the danger of the unfinished works,” and that various execution orders have been issued to the property owner, which have even led to a forced execution procedure by the City Council to correct this situation.

Among the ordered actions is the construction of a perimeter fence to prevent unauthorized access to the premises, as well as other measures aimed at ensuring the safety of residents and visitors.

Furthermore, municipal resolutions provide for subsidiary execution by the City Council and the imposition of monthly coercive fines equivalent to 10% of the cost of the ordered works, valued at 96,134.27 euros. They also contemplate the possibility of forwarding the facts to the Public Prosecutor's Office or the competent judicial authority in case of continued non-compliance.

“These resolutions clearly state what we have been demanding for years. There are legal mechanisms to act, and they must be applied to guarantee the safety of this space,” Bergaz affirmed.

“As the majority force, we will support any action aimed at guaranteeing safety, compliance with the law, and the defense of the general interest. This problem has been harming Costa Teguise, the business owners who comply with their obligations, and thousands of residents for too long,” he concluded.

 

Background of plot 216

By decree of the mayor of the Teguise City Council in 1999, a building permit was granted for the construction of a 5-star hotel, subsequently extended.

The Cabildo of Lanzarote filed an administrative litigation appeal against the resolution granting the extension and against a second extension that the City Council considered granted by positive administrative silence. This appeal was processed under ordinary procedure number 278/2015 before the Administrative Litigation Court number 1 of Las Palmas.

In said procedure, an order resolving the request for precautionary measures of June 21, 2005, was issued, which was dismissed and subsequently revoked on appeal by an order of the Administrative Litigation Chamber of the Superior Court of Justice of Canarias of 2005, which ended up adopting the suspension of the enforceability of the appealed acts, that is, of the license extensions.

For this reason, the works that were underway on plot 216 were halted. Until that moment, the structure of the authorized building had been erected with 4 floors in height. Finally, by a judgment of the Administrative Litigation Court number 1 of Las Palmas de Gran Canaria of September 6, 2010, in the ordinary procedure 278/2005, the appeal filed by the Cabildo was upheld and the appealed acts were annulled.

Currently, since 2020 and at the request of the owner, plot 216 is the subject of a minor specific modification of the General Plan, which would involve changing the classification of said plot - from non-hotel to hotel - with an increase in buildable area of 8,018 square meters, going from the current 15,316 to 23,334 square meters, and increasing the capacity from 328 to 500 beds, which will allow the skeleton to be saved and a new hotel to be built.

Said increases would be carried out in exchange, as the proposal states, for a parallel reduction in the buildable area of another hotel plot, plot 232, located above Las Palmeras avenue, which would change from hotel to residential, with a reduction of 8,018 square meters of buildable area - from 22,000 to 13,982 square meters - and a decrease in the number of beds from 471 to 299 residential.
