The European Council has definitively approved this Thursday the new European Union rules aimed at the return of people who do not have the legal right to remain at the continent's borders. The measure opens the door for States to open return centers for foreigners in countries outside the European borders.
The so-called Return Regulation was approved during the Council meeting by all the Interior Ministers of the European Union, with the exception of Spain, which voted against the regulation. This measure will not affect foreign minors who arrive alone at the European borders.
This measure seeks to complement the Pact on Migration and Asylum and expedite deportations. Meanwhile, the European Union assures that these measures must be used "with full respect for fundamental rights", the regulation obliges foreigners in an irregular situation to cooperate with the authorities because otherwise they could face economic or criminal sanctions if national law permits, and even be detained.
In order to open centers for the return of foreigners in third countries, the European Union assures that an agreement must be reached with the country in question, but it must be a state that "respects international human rights standards" and the principles of international law, including the non-refoulement agreement.
