Accuses a lawyer from Lanzarote of negligence, blaming him for not defending him

A resident of Lanzarote filed a claim for helplessness against his lawyer on June 21 because he claims that he was not warned in advance that he had to go to prison, nor did he appeal the decision to the Court.

The plaintiff requests the payment "of the patrimonial responsibility" and that the lawyer be sanctioned for alleged gross negligence for "not ceding his permission until the last moment, when nothing could be done anymore."

According to the document that La Voz has accessed, this citizen accuses the lawyer of not filing the appeal and of not warning him that he had to go to prison on the pretext that he had not paid his fees.

According to his new lawyer, Emilio Medina, "it is not the first time that something similar has happened with this law firm." Thus, he adds that his client was convicted of gender violence and his ex-partner of domestic violence, but while her defense filed the relevant appeal and was spared from prison, his lawyer did not.

"If that were the case, I would have been served a bill of costs, notified by certified mail, or resigned, and let the Court notify me so I could appeal," he stressed. In this way, he alleges that "two days later" he found out through a judicial notification that he had to go to prison.

In the claim, he stated that the expenses of the solicitor, 400 euros, and of the legal assistance, 3,500 euros, seem "excessive" to him, although he claims to have paid everything. In addition, he adds that the lawyer owes him 90 euros.

In addition, he insists that the lawyer could have appealed and officially requested his client to pay his fees. "He also didn't want to give me the documentation, hindering my defense," he concluded.

At this moment, his new lawyer is trying to get him a third-degree classification so he can get out of prison.
