The Territorial Team of the Judicial Police of Tías arrested on the 25th a male with initials A.S.H. - of Spanish nationality, 68 years of age and without a criminal record - as the alleged perpetrator of a crime against privacy, for taking photographs with his mobile phone under the skirt of a minor in a hotel.
The investigation began on the 24th with the complaint of the minor's mother, informing the Civil Guard that on that day, during a recreational activity in a hotel, allegedly A.S.H. took advantage of the moment when a minor bent down to pick up something while participating in some games carried out by the hotel's animation service to take a photograph of her under her skirt.
Based on the information in the complaint and the statement of several witnesses, the ETPJ located the alleged perpetrator of the crime, seizing his telephone and arresting him, to later make him available to the corresponding Court on duty in the town of Arrecife.
Review of the crime of upskirting
Although there is still no term in Spanish for this practice, taking photographs or recording videos under women's skirts or dresses without their consent is known as upskirting.
In Spain there is no specific article against this activity, but within the Penal Code it is framed as a crime against privacy in Title X of the Penal Code of Spain, and has provided for prison sentences ranging from one year to four years and a fine of twelve to twenty-four months.
