The Superior Court of Justice of the Canary Islands has confirmed the sentence of 3 years and 9 months in prison for the accused of selling heroin and cocaine from the call center he ran on Aires de Lima street in Arrecife.
The first instance ruling was issued by the Provincial Court of Las Palmas last April, and now the TSJC has rejected the appeal of the defendant, fully ratifying the ruling.
The case dates back to March 26, 2021, when the Police found 29 bags with 14.99 grams of cocaine and another 21 with 7.2 grams of heroin in that call center. According to the ruling, both would have had a value in the illicit market of about 1,250 euros.
In his appeal, the defendant argued that it had not been proven that these substances were intended for sale. In fact, during the investigation he claimed that they were for self-consumption.
However, both the Court and now the TSJC have rejected this argument, since they consider that there are sufficient rational indications to reach that conclusion.
Among them, the ruling includes "the amount of drug seized, the places where it was located, inside plastic boats, the seizure of a first shipment and the refusal of the defendant to admit that there was more drug in the premises, the seizure of more drug also located inside a plastic boat, the division of the drug into individual doses" and "the defendant's own recognition of the ownership thereof".
Thus, ratifies the conviction for "a consummated crime against public health in its form of substances that cause serious damage to health", confirming both the prison sentence and the fine that was also imposed, of 1,800 euros.
