The First Section of the Provincial Court will try next Tuesday in Arrecife those accused of selling and distributing marijuana and hashish in the Weed Apothecary Cannabis Association in Arrecife without a license or control.
The Prosecutor's Office's accusation is directed at C.G. as president and N.J. as secretary of said cannabis association.
The Public Prosecutor highlights in his indictment that the accused allegedly had "various suppliers" of hashish and marijuana, which was supplied at the Association's premises. However, according to this same document, there is no record that they had requested a license from the Spanish Agency for Medicines and Health Products to make this use.
The Public Ministry accuses C.G. and N.J. of allegedly allowing access to these drugs to an "indiscriminate plurality of people" since April 1, 2016.
So, to be a member of this cannabis association, it was enough to be a "cannabis consumer" or to have been diagnosed with a disease for which the therapeutic and palliative use of cannabinoids has been scientifically approved."
This space housed between April 28, 2016 and February 7, 2019 a total of 1501 members, without any record of cancellations.
Thus, the Prosecutor's Office highlights that "none of the association's rules contemplated that cannabis consumption should be shared inside or outside the premises, nor that members could obtain cannabis or a maximum withdrawal limit."
In these circumstances, C.G. and N.J. would have agreed to sell and distribute these substances in exchange for money. The Public Ministry collects different moments of alleged sales made between April 2018 and March 2019.
On March 14, 2019, the premises were entered and searched, where a precision scale, a member book, 2,377.18 euros in cash and various narcotic substances distributed in "small doses" were found, as well as 27 grams of cannabis leaf, 11.07 grams of hashish, 3,045 of marijuana, 123 grams of marijuana leaves and 11.7 grams of cannabis oil.
The value in the illicit market amounted to 5.42 euros per gram of hashish, 13.47 euros per gram of oil, 5.04 euros per gram of marijuana. So the grams of hashish are 256,908 euros, the oil for 157,599 euros and the marijuana for 15,477, 23 euros.
These facts constitute a presumed crime against public health, in the form of substances that cause serious damage to health, as well as a crime of illicit association.
For the president of the Cannabis Association, C.G. asks for three years in prison for an alleged crime against public health, as well as a fine of 31,783.474 euros, with the payment of a subsidiary civil liability of six months if he does not comply with the sanction, as well as special disqualification for the right of passive suffrage during the term of the sentence.
To this must be added, a prison sentence of four years for an alleged crime of illicit association and the payment of a fine of 24 months with a daily fee of 12 euros, as well as special disqualification for employment or public office for ten years.
In addition, the president had non-computable criminal records for the purposes of recidivism, as he was already convicted by a final judgment for a crime of attempted homicide.
While for N.J., as secretary of the Association, he requests three years in prison for a crime against public health and a financial penalty of 31,783.474 euros, with the payment of the subsidiary personal responsibility of five months. He also asks for another three years in prison for the crime of illicit association and the payment of a fine of 24 months with a daily fee of 12 euros.
To conclude, the dissolution of the premises, located on Calle La Inés, was carried out.
