The Prosecutor's Office requests fifteen years in prison for raping a child, the son of his stepmother, in Lanzarote

The Sixth Section of the Provincial Court of Las Palmas will try, on November 26 in Gran Canaria, a defendant accused of raping the minor son of his father's partner in Lanzarote.

The events date back to between September 2022 and January 2023, when the accused W.A.G.R., of Colombian nationality, resided with his father, his father's partner, and her eleven-year-old son in a home in Arrecife.

The Prosecutor's Office accuses him of taking advantage of his position of "superiority and familiarity" to allegedly ask the child to perform fellatio or to penetrate him anally. The accused allegedly took advantage of the occasions when his father and stepmother were out of the house to subdue the minor, or the moments when the parents were sleeping.

On other occasions, the Public Prosecutor's Office accuses him of raping the child at night in the room they shared in the family home. This situation allegedly went on for some time, sometimes daily for weeks and other times about three times a week.

The Ministry points out that W.A.G.R. allegedly convinced the minor not to tell anyone, under the pretext that it could harm his mother.

 

Fifteen years in prison and compensation of 30,000 euros

The accused has been in provisional detention for this case since February 15, 2024. The Public Prosecutor's Office is seeking 15 years in prison for the accused, disqualification during the sentence, and a prohibition from approaching the victim within a distance less than 500 meters, from her home, workplace, or any other place frequented by her, as well as a prohibition from communicating by any means for 16 years

In addition to imposing special disqualification during the term of the sentence to exercise their rights of parental authority, guardianship, conservatorship, custody, or foster care for eight years.After serving his prison sentence, the Public Prosecutor's Office requests supervised release for ten years, disqualification from practicing any profession, trade, or activity, whether paid or unpaid, that involves regular and direct contact with minors for 20 years. Additionally, payment of court costs.Thus, the defendant shall compensate the victim through their legal representative with **30,000 euros for the moral damages caused**
