The First Section of the Provincial Court of Las Palmas will judge on May 28 in Lanzarote a man accused of raping his underage daughter with intellectual disability when she was only 12 years old.
The events date back to August 2012, when the minor was spending the holidays at the family home with her father in Arrecife. The Public Prosecutor's Office accuses F.M.L. of allegedly laying the girl on the bed and vaginally penetrating her "taking advantage of his position of superiority and kinship" and "with lustful intent to satisfy his sexual desires".
The events constitute a crime of sexual abuse of a minor under 13 years old, as they occurred before the approval of the Organic Law of Only Yes is Yes in 2022, where these would be classified as sexual assault.
The Public Prosecutor's Office requests 12 years in prison, absolute disqualification, and the payment of legal costs. Additionally, it imposes on the accused the measure of supervised release for ten years, the prohibition of approaching his daughter within 500 meters, and of communicating with her for 13 years.
Furthermore, he will have to compensate her with 30,000 euros for the moral damages suffered.
