The judge indicts Raúl Asencio and his 3 former teammates for sharing sexual videos of a minor

The investigation into the case opened against four soccer players for allegedly recording and sharing sexual videos with two young women, one of them a minor, has concluded.

The Court of Instruction number 3 of San Bartolomé de Tirajana of Gran Canaria has formally processed Real Madrid defender Raúl Asencio and his former teammates in the club's lower divisions Andrés García, Ferrán Ruiz and Juan Rodríguez for recording sexual images of two women, one of them a minor, and disseminating them without their consent.

As reported this Wednesday afternoon by the Superior Court of Justice of the Canary Islands (TSJC), the judge in charge of the case has issued the order that ends the investigation and formalizes the criminal process against the four involved, which now opens the way for the Prosecutor's Office and private accusations to file charges and request the opening of a trial.

The instructor of the case appreciates indications of the following crimes: discovery of secrets without consent and violation of privacy (article 197.1 of the Penal Code), distribution and sending to third parties of the videos without warning the victims or their consent (article 197.3) and capture or use of minors for pornographic purposes and possession of child pornography (article 189, 1 and 5 of the Penal Code).

The TSJC has announced the decision in a brief statement that does not mention the names of the soccer players, but does specify that it affects the four involved in the investigation; that is, Raúl Asencio, Andrés García, Ferrán Ruiz and Juan Rodríguez, the latter three already out of the white club.

It has also not detailed what acts are attributed to each of them, nor has the judicial resolution been made public, because it contains intimate data regarding a minor.

The events allegedly occurred on June 15, 2023 in a tourist complex in the south of Gran Canaria, when the four soccer players met the two complainants, aged 16 and 18 at the time of the events.

According to the complaint filed at the time by the mother of the minor, she had consensual sexual relations with the soccer players, although she did not give permission for them to record her or much less for them to later share the video via Whatsapp, as they later discovered had allegedly happened.

Then, the second young woman, this one of legal age, also denounced the dissemination of a video of sexual content that, presumably, some of the investigated would have recorded while maintaining consensual relations, although in her case neither the recording nor the subsequent dissemination of the images were.

However, in the last order made public on this matter - a resolution of the Las Palmas Court that rejected leaving Asencio out of the case - the defense of the only soccer player of the four who still plays for Real Madrid argued that his client had not participated in the recordings and that the video that he is accused of having shared was not on record in the case.

After learning of this processing order, Asencio's lawyer, Juan Gonzalo Ospina, has declined to make an assessment to EFE, although sources close to the case have confirmed that all the appeals deemed appropriate will be filed against this judicial resolution.

The order itself specifies that both the defenses and the accusations may file an appeal for reconsideration; that is, they may ask the same judge who issued it to reconsider his decision.
