The Canary Islands Council of Bar Associations has annulled the registration as a lawyer of former magistrate Salvador Alba, after upholding the appeal filed by Victoria Rosell, magistrate and victim of the crimes for which Alba was convicted, according to CanariasAhora . The resolution considers that Alba does not meet the requirements established both in the General Statute of the Legal Profession of 2021 and in the statutes of the Las Palmas Bar Association since 2016, as he has a criminal record for crimes that involve serious penalties, such as the special disqualification for 15 years imposed by a final judgment. Despite the fact that the General Council of the Legal Profession endorsed his membership based on a regulation that has already been repealed, the Canary Islands body has considered that the previous regime cannot be applied to him because he has no acquired rights.
The resolution dismantles Alba's argument that it was a reinstatement and not a new registration, recalling that he voluntarily resigned from the Córdoba Bar Association in 1995, which extinguishes any previous link. In addition, the Canary Islands Council highlights that the Las Palmas Bar Association already included a clause since 2016 that prohibits the registration of people with serious penalties, anticipating the state regulations of 2021. Therefore, even if the application of the previous regulations is alleged, that local provision already prevented Alba's registration, leaving his application for registration without legal basis.
The Council also emphasizes the damage that his membership would cause to Rosell, who could find Alba in judicial proceedings within the same judicial district, generating a situation of revictimization and affecting her professional work. The possibility that the magistrate would have to assess writings presented by her aggressor, or be forced to abstain in cases, would alter the normal functioning of the court. This situation would cause continued moral damage to Rosell, hindering her recovery and her professional life. Therefore, Alba's registration is annulled with retroactive effect from March 2025.
