The administrator of Inmobiliaria Masar Canarias SL admits to having swindled a client in Arrecife out of 91,000 euros

The Sixth Section of the Provincial Court of Las Palmas has judged this Friday in Arrecife a man accused of a crime of misappropriation. M.F.L. agreed to have swindled a company in the sale of two properties that were never delivered in Avenida Fred Olsen in Arrecife.

The Public Prosecutor's Office, the private prosecution and the defense have reached an agreement by which this citizen assumes a prison sentence of six months, disqualification from passive suffrage during the term of the sentence, a fine of four euros per day for three months and the payment of civil liability for the 91,000 euros defrauded.

The events date back to 2022, when M.F,L. administered Inmobiliaria Masar Canarias SL, which built different homes in the Reducto de Arrecife. At that time, this entity signed two contracts for the sale of housing to be built with A.G.B., on behalf of TelecamBravo SL. One of the houses would be valued at 129,000 euros and the other at 370,000 euros.

According to the Prosecutor's Office, in the sales contract the aforementioned real estate company promised to deliver the homes before February 28, 2005, being extendable for six months in cases of force majeure.

At that time, TelecamBravo SL granted 91,000 euros to the real estate company as initial payments. However, not only did it not obtain the homes, but it did not return the amount, receiving "evasive answers and different excuses".

At the beginning of the hearing, the Public Prosecutor's Office modified its indictment and went from asking for five years and nine months in prison to six months. The reason is the mitigating circumstance for undue delays in the judicial process, "as ten years have passed since the initiation of the process and the beginning of the trial", the prosecutor explained. "A disproportionate time," he adds.

For this reason, the defendant's defense has requested the suspension of the prison sentence, as it is a ruling of less than two years. The ruling must wait for the Chamber, led by Emilio Moya, to ratify that the confessed perpetrator of a crime of misappropriation has no criminal record and can suspend the prison sentence. If approved, if he commits another crime during this time he must pay with the current sentence of six months and the next.
