The Sixth Section of the Provincial Court of Las Palmas will judge this Friday, July 14 in Arrecife the administrator of a real estate company accused of a crime of misappropriation. MFLS would have allegedly kept 91,000 euros from a client with whom he agreed to the sale of two houses to be built in front of El Reducto in Arrecife.
The events date back to 2002, when the accused MFLS was the administrator of the entity Inmobiliaria Masar Canarias SL, which was building several houses in the Reducto area. In September of that year, the real estate company signed two contracts with the company TelecamBravo SL for two houses to be built on a plot on Avenida Fred Olsen for a price of 129,000 and another of 370,000 euros.
According to the Prosecutor's Office's indictment, the real estate company had to deliver the houses before February 2005, which could be extended for six months in case of force majeure. From then on, the payer could claim the money delivered.
TelecamBravo SL paid Inmobiliaria Masar Canarias SL a total of 91,000 euros in two checks. However, it obtained neither the corresponding houses nor the refund of the money. When requesting the refund, he received evasive answers and excuses from the accused MFLS, according to the Public Prosecutor's Office.
According to the Prosecutor's Office, the accused would not have used the money for the houses, as he should have, but could not prove where he invested or spent that amount.
For the above, the Public Prosecutor's Office asks for the administrator of the real estate company as the author of a crime of misappropriation the penalty of five years and nine months in prison; a fine of 12 months, with a fee of 20 euros per day; special disqualification for the right of passive suffrage during the time of the sentence and payment of costs.
At the same time, as a form of civil liability, he must compensate TelecamBravo SL with 91,000 euros and in other amounts that he proves as economic damage derived from the allegedly committed acts.
