The man who was arrested at the Lanzarote airport in 2015 with drugs inside his body has admitted the facts and has accepted a three-year prison sentence. The defendant has reached an agreement with the Prosecutor's Office, which has also imposed a fine of 1,287 euros.
It should be remembered that initially, the Public Prosecutor's Office requested a sentence of six years in prison and a fine of 3,356 euros for A.T. A for a crime against public health in the form of substances that cause serious damage to health. Thus, with the agreement of conformity, his sentence has been reduced.
In addition, the defense lawyer has requested the suppression of the custodial sentence. He has argued that if his client committed the crime it was because he himself had consumed the substances he was carrying and has argued that he has been in rehabilitation treatment for drug use. In this regard, the President of the Chamber has indicated that this issue will be resolved in the execution of the sentence.
Hashish and cocaine worth almost 1,300 euros
During the trial held this Tuesday, the defendant has acknowledged that on April 22, 2015 he arrived in Lanzarote with 89.08 grams of hashish and 35.20 grams of cocaine inside his body, on a Ryanair flight from Santiago de Compostela. In total, the drugs he was carrying would have reached a market value of 1,284 euros.
In his sentence, the aggravating circumstance of recidivism has been applied, since A.T.A was already sentenced in April 2016 by the Provincial Court of Vigo to two years in prison for a drug trafficking offense. However, the mitigating circumstance of undue delay has also been applied, since, according to the Prosecutor's Office, the case was paralyzed between April 24, 2015 and June 9, 2016 due to the analysis of the substances seized.
The convicted person must also pay the costs of the trial, as ruled this Tuesday. In addition, the judgment includes the confiscation and destruction of the seized drugs.
