Sentenced to compensate the elderly man kicked in a roundabout in Arrecife with 350 euros

The ruling, which has been appealed by the victim's defense, fines the convicted and contemplates that they pay for the damages caused to the victim's vehicle.

The Court of Instruction number 2 of Arrecife sentenced Pedro Manuel R. and Samuel D. for assaulting an elderly man two years ago in Lanzarote after a traffic conflict in Lanzarote. The events took place in June 2023 and went viral in a video that was spread on social networks, where Samuel Díaz is seen kicking the victim T.S. in the face at the Los Geranios roundabout, in Arrecife. 

The victim, who was driving a car, filed a complaint at the police station that same day accusing both of committing a minor crime of injury and another of damage. At the same time, the accused, who were riding a motorcycle, reported T., who has been acquitted, for a crime of injury and threats. 

The judicial ruling to which La Voz has had access, issued in May 2024, states as proven facts that T. was driving his vehicle from Puerto Calero to Tahíche when, at the height of the Puerto del Carmen detour, "a motorcycle overtook him on a continuous line and pulled in front of him, abruptly reducing speed." At that moment, T. had to brake abruptly and honked at the convicted men, who responded with a middle finger.

According to this judicial ruling, T. continued driving and shouted at the occupants of the motorcycle "if they were crazy." After that, Samuel and Pedro "became aggressive" and placed themselves at the height of the victim "very close to the passenger window." T. accelerated for fear of the defendants and they followed him, making "zig zags with the motorcycle."

At one point, T. started following them to the detour of the bridge that goes to Tahíche, there they stopped the motorcycle. After that, they followed T. again and Pedro threw a stone at him "causing damage" to the rear left of the vehicle. According to the same document, the motorcycle stopped and T. parked in front of them with his vehicle and got out of the car. Samuel Díaz, who was driving the motorcycle, hit T. "in the face very hard", then hit his leg several times with the car door. Finally, Samuel kicked him in the face three times. 

The victim, who was acquitted of the complaints of the convicted, suffered several injuries such as bruises, contusions and wounds in different parts of his body, including the head. In addition, the Court declared proven that Pedro R. and Samuel D. caused damage to his vehicle worth 106.19 euros. 

The Court has sentenced Samuel D. for the crime of injury to three months of fine with a daily fee of 10 euros and to the payment of compensation to T. for 350 euros, and for the crime of damage to three months of fine with a daily fee of three euros, as well as to pay 106 euros for the damage caused to the vehicle. 

Meanwhile, Pedro Manuel R. was sentenced for the crime of damage to a fine of three months with a daily fee of three euros and to respond jointly and severally for the 106 euros of damage caused to T.'s car. Finally, T. has been acquitted of the minor crime of which he was accused. 

The resolution, which is not final, has been appealed by T.'s defense on the grounds that the sentence is insufficient.
