The Second Section of the Provincial Court of Las Palmas will try on February 4 in Gran Canaria a defendant accused of sexually abusing a minor of 16 years in Lanzarote. This trial will be held this February despite initially being scheduled for last September in Arrecife.
According to the indictment of the Public Prosecutor's Office, the defendant A.F.O.C., who was 27 years old at the time of the events, had a romantic relationship with a minor of 16 years for three months, between June and September 2021.
On September 11, 2021, at approximately 03:00 hours, the defendant was with the victim in the apartment of a friend of the minor in Arrecife. The Public Prosecutor's Office states that, when the time came for farewell and once they were both at the door of the building, the man, knowing that she was under 16 years old and with "libidinous intent," allegedly began to kiss the minor on the mouth and neck, tried to remove her shirt and touched her chest, despite the victim removing his hand and asking him to stop.
The Prosecutor's Office classifies the events as a crime of sexual abuse of a minor under 16 years of age and requests three years of imprisonment for him, with special disqualification for the right to passive suffrage during the term of the sentence. In addition, a prohibition to approach the victim, her home, and her place of study or work at a distance of less than 500 meters, as well as a prohibition to maintain any type of communication by any means, whether handwritten, telephone, computer, or telematic.
If he is found guilty, the Prosecutor's Office requests five years of supervised release after serving the prison sentence, as well as a special disqualification from any profession or trade, whether paid or unpaid, that involves regular and direct contact with minors for a period of three years longer than the prison sentence imposed.
Finally, the Public Prosecutor's Office requests that he face civil liability and compensate the victim through her legal representative with 2,000 euros for the moral damages caused.
