Man faces twelve years in prison for raping his sister-in-law's daughter in Lanzarote

The Prosecutor's Office accuses him of using his familiarity with the minor to allegedly sexually assault her for two years

The Sixth Section of the Provincial Court of Las Palmas will try a man on December 18 in Arrecife accused of sexually assaulting his sister-in-law's daughter in Arrecife.

The Prosecutor's Office accuses D.J.L.S. of allegedly raping the girl in the home they shared in the capital of Lanzarote.

The Public Prosecutor's Office accuses him of taking advantage of moments when no one else was in the house and of using his family relationship with the minor to allegedly sexually assault her and caress her private parts while they watched television on the sofa or in bed.

In this regard, the Prosecutor's Office asserts that these alleged sexual assaults occurred with increasing frequency, almost daily. The Public Ministry accuses the defendant of aggravating the assaults, proceeding to rape the minor from June 2016 onwards and continuously until 2018. Thus, it accuses him of forcing the girl to perform oral sex on him.

All of these sexual assaults would have been carried out under duress, as the Public Prosecutor's Office indicates that the minor was afraid that the accused D.J.L.S. would harm her or tell her sister about it.

The minor decided to report the events in January 2020 due to the fear that the accused might repeat these alleged assaults against her young cousin.

The Prosecutor's Office accuses him of committing a continuous offense of sexual abuse with penetration against a minor under 16 years of age. This offense is classified as sexual abuse and not as assault because it is based on the previous Organic Law 10/2022, known as the "Only Yes Means Yes" Law. 

The defendant faces twelve years in prison, disqualification for the duration of the sentence. In addition to the **prohibition of approaching** the victim, her home, her workplace, studies, or any other place where she may be within 500 meters, as well as the prohibition of communicating with her for fifteen years

In addition, he faces ten years of supervised release and 17 years of special disqualification from "any profession or occupation" involving regular contact with minors for 17 years. He must also pay court costs and a €20,000 compensation for the emotional damages caused to the minor.
