The Court of First Instance number 3 of Arrecife (Investigating Division) has decided to keep the case regarding the Arrecife City Council's actions in the dismantling of Hormiconsa's crusher in Maneje, which was delayed ten years from when the Provincial Court of Las Palmas ratified its demolition, archived.

The investigating judge Silvia Muñóz has made the decision to keep the case under provisional dismissal after receiving an additional report from the Nature Protection Detachment Unit (Deprona) of Timanfaya at the beginning of October.

Thus, she has ruled that everything related to the compliance of the dismantling of this crusher must be followed up in the Criminal Court, which must enforce the sentence.

The investigating body recalls that the Hormiconsa crusher case was already brought to trial in 2011. Specifically, the Criminal Court Number 3 of Arrecife sentenced the sole administrator of the company, Miguel Morales, to one year and eight months in prison for a crime against territorial planning and another of serious disobedience to authority.

At that time, the judicial ruling already obliged the developer to demolish Hormiconsa's warehouses, the concrete plant, and the aforementioned crusher.

The sentence was later ratified by the Provincial Court of Las Palmas in 2015. However, in 2025 this crusher was still operating despite the sentence that ordered its demolition and despite not having the relevant enabling title. The Arrecife City Council then described the events as "very serious".

In addition to the criminal proceedings that convicted Hormiconsa, an enforcement phase of the sentence was also opened in the same court in 2015.

Last June 30, the Court of First Instance decided to provisionally dismiss the case and indicated that it will be in the Criminal Court number 3 of Arrecife where "all those aspects" related to the compliance of the cessation of activity "should be clarified". Thus, the investigating court states that the facts could constitute a presumed crime of disobedience.

De León points out "false accusations" and accuses the media of "distorting actions"

The mayor of Arrecife, Yonathan de León, has stated that "the citizens must know this file of the case, and wishes that, with clarity, the same media and the complainant cease their misrepresenting and manipulative actions". De León has branded the complaint promoted by the neighborhood group Asociación Colectivo contra la Delincuencia Galguen and the Seprona as "false accusations".

"My neighbors deserve to know all the information. It was published that complaints had been filed against me and now it is appropriate to explain that, after receiving that documentation, the court has maintained the dismissal of the case," de León continued.

“As mayor, my responsibility is to act with rigor and attend to the needs of Arrecife. I am going to continue doing so, with closeness and dedication," he states. "My commitment to this city remains intact. The neighbors expect work, answers, and solutions, and to that I will continue dedicating all my effort," concludes the mayor of Arrecife.
