The judge approves the quarantine for coronavirus in the hotel in Tenerife

The Ministry of Health requested permission because its decision implies deprivation of free movement for citizens

The Court of Instruction number 1 of Arona (Santa Cruz de Tenerife) has ratified the order of the Ministry of Health of the Government of the Canary Islands that last Monday imposed the quarantine of the hotel in Adeje where the presence of a person affected by coronavirus had been confirmed.

The Ministry of Health of the Government of the Canary Islands addressed the Court of Guard in Arona this Tuesday requesting, in accordance with the law, the ratification of the measure.

In the order that supports the measure, Magistrate Daniel Pedro Álamo González recalls that, since it is a matter of maximum urgency, the law authorizes the accidental competence of a criminal judicial body to resolve an issue of an administrative nature, which in principle should be resolved before the contentious-administrative jurisdiction.

In addition, since an body of this order was not available as last Monday was a non-working day in Santa Cruz de Tenerife due to the festivity of the Virgen de Candelaria, the action of the Ministry could only be endorsed by the Court of Guard.

 

Avoid propagation 


"There is a confirmed case with a person infected by said virus, and with reasonable indications that said disease may spread, which, for the purposes of medical assessment, makes (...) quarantine necessary in the premises of said hotel for the control of patients, of people who have had contact with said people, and to avoid propagation", the judge points out. 

The magistrate states that, in view of "the serious health problem existing worldwide to date with the so-called corona-virus, or Covid-19, the risk of propagation, the need to adopt urgent and forceful measures to avoid propagation", it is appropriate "to ratify said measure, in order to avoid greater contagion and propagation and due to the danger to public health, in accordance with the International Health Emergency Declaration due to the coronavirus outbreak".
