The Criminal Chamber of the Superior Court of Justice of the Canary Islands has rejected a new attempt by an alleged environmental association from Gran Canaria, Jacón, to enter the Stratvs case. Thus, the Court has endorsed the decision of the investigating judge, Silvia Muñoz, who already dismissed the appearance of this group, even accusing it of "procedural fraud".

"The appearance is not admissible as the procedure has expired", states the TSJC's order, signed by Judge Carla Bellini. At the time, Judge Silvia Muñoz already stated, among other things, that this association did not exercise the power to appear as a popular accusation in time. Furthermore, she stated that there were doubts about their true interest in this case and that they had not provided all the necessary documentation.

Jacón first tried to enter the Stratvs case in mid-2015, when it was not even officially registered as an association. And its attempt to appear coincided with the withdrawal from the case of an environmental association from Fuerteventura, Agonane, who withdrew from the procedure stating that they felt "deceived and used" by the lawyer who led them to appear, Juan David García Pazos. They even stated that it had only "added noise" to the procedure, hindering the case.

Just afterwards, Jacón appeared asking to appear. At that time, García Pazos denied to La Voz that he had any relationship with the new association. In fact, he assured that he did not even know it. However, he has since acted as Jacón's lawyer, at least in one procedure.

 

Attempts to appear in other cases by the same lawyer


Specifically, Jacón requested in the Courts the "urgent closure" of five wineries in La Geria, located in the municipality of San Bartolomé, maintaining a very similar position to that previously defended by the owner of Stratvs, Juan Francisco Rosa. In fact, a businessman linked to him demanded two years ago the closure of all the wineries in La Geria, shortly after the Justice ordered the closure of his own. In the case of Jacón, he intended that the Court agree to this precautionary measure without even hearing the City Council, which is what the Contentious-Administrative Court Number 5 of Las Palmas rejected.

In addition to this case, Juan David García Pazos has also tried to appear as an accusation through another association in other corruption cases opened on the island, such as the Unión case. It so happens that in that same procedure, García Pazos intervened at least in one hearing as a defense lawyer for one of the main defendants, the businessman Luis Lleó.

In the case of this association of jurists, it was also not constituted when it began to try to appear in all the pieces of Unión, six years after the case publicly broke out and when the investigation was already closed. Finally, the Audiencia allowed its appearance only in one of the pieces, which was the only one that was at that time in the investigation phase. And the first thing he did was to recuse the investigating judge, who is also Silvia Muñoz. The document requesting the recusal of the magistrate was also signed by García Pazos.
