The first section of the administrative court of the High Court of Justice of the Canary Islands (TSJC) has declared "adjusted to law" the opposition to the fire brigade of the Consortium of Security and Emergencies of Lanzarote, which took place between the end of 2008 and the beginning of 2009, thus ratifying the judgment of first instance. The PIL, responsible at this time for the Consortium, has expressed "its satisfaction" for this ruling, after "a long judicial process initiated in May 2009".
Initially, the Court of Administrative Litigation number 1 of Las Palmas ruled in 2013 dismissing the appeal filed by five opponents, who were found unfit. In addition, the Court validated the resolution of June 12, 2009 under which the claim filed was rejected, requesting the annulment of the selection process or that, alternatively, the psychological phase be annulled so that a competent psychologist could evaluate the results obtained in the psychotechnical test.
The plaintiffs, "once declared unfit", alleged, among other things, the existence of a violation of the general and constitutional principles in the development of the psychological test for not ensuring anonymity in the preparation and correction of the tests.
The PIL has assured that it was attempted "to question with its arbitrary statements not only the development of the regulated process and duly published in the corresponding Official Bulletins, but also the action, professional and discreet, of the public officials appointed for that purpose, and that representing the firefighters themselves, the consortium municipalities, the Cabildo and the Government of the Canary Islands acted at all times with rigorous professionalism and maximum objectivity".
The PIL has insisted in a statement that, as for the substance of the matter, at the time the Consortium itself replied, and as it is accredited in the file and exposed before the Chamber, that "the constitutional principles of equality, merit and capacity had been respected at all times, and that the psychotechnical tests were carried out by a qualified technician, as required in the call for applications".
The bases, in addition, established the criteria that should be taken into account for the evaluation of the same, which were public, and that also "knew each and every one of the opposing candidates". "In the same file, the results were perfectly motivated, not only of the psychotechnical test, but of all the tests carried out", the PIL has defended.
This party has shown its "satisfaction" for this ruling of the Superior Court of Justice of the Canary Islands and has conveyed its "congratulations to all the firefighters-public employees who were found fit in the process". "We understand that it is fair to publicly recognize once again the good work, objective and professional, carried out by each and every one of the members of the court that acted during the selection process", he said.
