The councilors of the Popular Party of Yaiza, Juan Monzón and Guayo Rodríguez, regret that the "null management" of Mayor Oscar Noda in relation to the "garbage problem in the municipality is causing the city council to face adverse judgments that force it to pay court costs.
According to the municipal spokesperson, Juan Monzón, the "manifest irresponsibility" of Oscar Noda causes the consistory to enter into "legal disputes that are known to be lost in advance." Monzón points out that "he was already warned that this would happen with the hotel chains that felt harmed because they were being provided with a precarious garbage collection service."
The Populars insist that "the solution to the serious problem suffered by the municipality is to put out to tender, once and for all, the collection service," which "today continues to be provided precariously and with a company that, no matter how much the fee is increased, does not improve its service and leaves a deplorable image that residents have been suffering for many years."
Convicting sentences
On April 26, 2023, the Administrative Court No. 1 of Las Palmas, ruled declaring the nullity of the resolution issued by the Yaiza City Council and imposing the payment of costs to it, against the company Hernández Bello S. L., former concessionaire of the waste contract in Yaiza.
It should be remembered that "Hernández Bello was the concessionaire of the waste collection service in the southern municipality." This service, finally "was rescued by the consistory due to continuous breaches of contract by the company." "Due to these breaches, several hotel establishments in the tourist area of Playa Blanca resorted to external companies to remove the garbage accumulated in their facilities, later claiming the cost of the services from the consistory."
For all this, "the same contentious court, dated September 1, 2023, attends to the demand of the company Teide 10 S.L., again ruling against the Yaiza City Council and declaring patrimonial responsibility of the consistory, condemning it to pay 31,133.84 euros, plus the court costs thereof."
