The court rejects the PSOE's access to the Ginory file, siding with the City Council

Yonathan de León: "The PSOE knew about the court's ruling and preferred to muddy the electoral campaign with false accusations, Cristina Duque has it in her DNA”

The court has ruled, in a court order last May, "that the general interest must prevail, defended by the Arrecife City Council", and its mayor, over the PSOE's intentions to know the resolutions on the settlement of the compensation for the expropriation of the Ginory land, "a procedure that began more than 25 years ago, with the PSOE governing the Arrecife City Council", according to reports from the Consistory.

The presiding judge of the Administrative Court number 6 of Las Palmas, issued a court order on May 3, 2024, granting the Arrecife City Council the reason, against the "precautionary" measures requested by the PSOE spokesperson in Arrecife, Alfredo Mendoza, "regarding access to information on the settlement of legal interests to which the Arrecife City Council was sentenced due to the inaction of the former mayor Eva de Anta, of the PSOE, on the payment of compensation for the expropriation of the Ginory land", they point out.

From the Government Group they point out that "despite the existence of this court order, which the PSOE knew about, this left-wing political formation wanted to make the public believe that the mayor of Arrecife, Yonathan de León was obstructing access to this file". "The reality, as has been proven, is that the Legal Advice of the Arrecife City Council issued three reports stating that the measure requested by the PSOE, through its councilors Alfredo Mendoza, Cristina Duque and Roy González, could affect a process that the court must still resolve regarding the amount of legal interest, and the aggravated penalty of two more points, due to the inaction of Eva de Anta as mayor of Arrecife, having Cristina Duque as advisor, in whose documentation on record is the mediation of councilor Duque in this procedure", they add from the Consistory.

The court order, which puts a stop to the PSOE's claims, highlights "the damages that are invoked are also directly linked to the substantive issues, so, weighing the concurrent interests, the general or public ones must prevail, being for all this that the appeal, if the interested measures are not adopted, and finally estimated, would not lose its legitimate purpose, for all of which, it is not appropriate to grant the precautionary request". As is known, they recall from the Mayor's Office, "this land known as the Ginory land is municipal property. The court is only resolving the amount of legal interest, after the City Council was sentenced, in the stage of Eva de Anta (PSOE) to the payment of 5% of legal interest, aggravated by two points due to inaction".

The mayor of the city, Yonathan de León, has made the existence of this court order, dated May 3, known to the citizens. Even so, the first mayor has highlighted, "the PSOE, and councilor Cristina Dique wanted to muddy the closing of the campaign for the Europeans. The false accusations are in the DNA of the PSOE and the councilor who signs their statements".

In addition, in the statement the mayor has also provided the pronouncement of the Public Prosecutor's Office where he opposed these precautionary measures requested by the representative of the PSOE. The Prosecutor makes it clear that "the next elections will be in 2027, and the mayor cannot obstruct either evidence or documents".

Yonathan de León recalls that "the PSOE cannot give lessons on transparency and defending the public interest. The city is paying exorbitant legal interest because Eva de Anta, and her entourage, did nothing to avoid or defend them", 

Finally, the mayor has announced that "the PSOE's lawyer in this procedure is Octavio Topham Camejo, who replaced Cristina Duque as advisor to the Deputy of the Common, a position she held until the summer of last year 2023".
