The Princesa Yaiza hotel is not legalizable. This is the decision of the Yaiza City Council, which has "unfavorably" reported on the legalization project presented by the property of this hotel, whose license was annulled by the Superior Court of Justice of the Canary Islands. According to the City Council, the Governing Board approved this Monday a proposed resolution declaring the "impossibility of legalization" of this building, because it does not conform to the "determinations established by the General Plan." It gives the property two months for its "adaptation and accommodation" to the regulations, "including partial demolition, if necessary."

This is the second hotel owned by Juan Francisco Rosa that may have to be demolished, at least partially. The first one on which the City Council ruled was the Son Bou. In this case, the City Council ordered its total or partial demolition, as it triples the permitted building area. Although Rosa has already presented a project to comply with the municipal mandate, the City Council concluded that this project also did not conform to what it had ordered.

Regarding the Princesa Yaiza, the technical and legal reports of the City Council conclude that it is "impossible" to legalize the hotel as it is right now. Among other things, it has 5,116.05 square meters more than allowed, since according to the measurements made by the City Council, there are a total of 39,649.85 meters built. In addition, according to the City Council, "the building exceeds the habitable area in basements by about 1,000 square meters."

Also, the occupation above ground is above the parameters established by the General Plan. Specifically, the current occupation percentage is 47 percent of the plot, compared to the 40 percent allowed by the current Plan.

What it does comply with, under the new General Plan, is the height parameter and the number of accommodation places, according to the City Council. "The building has 4 floors and the maximum height dimension established in the General Plan regulations is 4 floors and/or 14.40 meters," the City Council points out. Regarding the places, it could maintain the current 330 rooms.

 

One month to present the project and another month to execute it


In the resolution approved this Monday, the City Council gives the property one month to present the project and another month to execute it. In that project, it must contemplate "in a detailed and thorough manner all the technical measures to be executed, including partial demolition (if necessary)."

In addition, the City Council has already forwarded this agreement to the Superior Court of Justice of the Canary Islands, within the procedure to execute the judgment that declared the license of this hotel illegal. In a press release, the City Council also states that it "maintains its offer of total willingness and collaboration with the aim of finalizing this entire process with absolute transparency and technical and legal rigor."

Finally, "for the good of the tourism industry, the maintenance of jobs and the image of the destination," it asks the promoters with annulled licenses "to make the maximum possible technical effort so that they can legalize their situation in accordance with the law and the new urban planning scenario marked by the General Plan, even if this means modifying the current structure of the buildings."
