The candidate of Coalición Canaria for Mayor of Yaiza and Secretary of Organization of the Local Committee, Emilio Machín, states that "he has been forced to resort to the right that assists him as a public official of the Yaiza City Council to access the documentation of the institution and be able to see the details of a 7,000 euro telephone expense bill presented by a councilor of the southern Consistory."
Machín affirms that “something is hidden” behind the refusal of the mayor, Óscar Noda, who is also responsible for the Area of Economy and Finance, to provide him with the requested information; so he has been forced to present a writing protected by article 25.1 of the Canary Law 7/2015 of municipalities.
“We are not going to allow public money to be played with in this way. Yaiza is a municipality with many shortcomings and an expense of this nature is a real disgrace,” he says.
As explained by the CC councilor, "after several unsuccessful attempts, in the exercise of his supervisory work, on December 4 he requested through registration by electronic means access to the telephone bills of the Yaiza City Council between June and November 2022",
However, he adds, "after twelve days, on Friday, December 16, there was still no response, so he decided to take the next step and present a letter addressed to the mayor, reminding him that the Canary Law of municipalities establishes that requests for information must be resolved within a period not exceeding five calendar days from its presentation."
Specifically, article 25.2 of Law 7/2015 emphasizes that “once the deadline to resolve the request has passed, without an express denial resolution having been issued, it will be understood to be estimated by silence and the general secretariat must provide the applicant with direct access to the file or deliver the requested information. Failure to comply with this duty will entail disciplinary responsibility for obstruction of the constitutional right to freely exercise public office.”
Machín trusts that his right to have the requested information will not continue to be obstructed and that the deadlines set by law to do so will be met.
“The letter was presented on Friday the 16th, I hope it will be considered presented, that my request is understood to be accepted and that the General Secretariat provides me with access to the required information immediately. The opposite would be an absolute lack of the democratic spirit and institutional transparency that the mayor so often proclaims,” says the CC candidate.
