Canal Gestión Lanzarote says it will appeal the seizure of the service and will request precautionary measures to recover it

The subsidiary company of Canal Isabel II of Madrid warns that it is not responsible for incidents in the integral water cycle "from now on" and accuses the Consortium of acting in a "hasty and disproportionate" manner.

Canal Gestión Lanzarote has rejected this Monday midday the seizure of the service integral of water on the island by the Water Consortium, which became effective on June 3.

At the same time, it has indicated that it is not responsible for "the incidents that may occur from now on as a consequence of the incomprehensibly immediate and disproportionate action, with no time to prepare a minimal orderly transition of the service."

Furthermore, the subsidiary of Canal Isabel II from Madrid has warned that it is within the deadline to appeal the resolution of the contract and that it will exercise "all" legal and administrative actions, including the request for precautionary measures, to suspend the seizure of the service.

The company has assured that the takeover of the integral water cycle by the public entity was "precipitated, disproportionate, and contrary to the principles of legal certainty." At the same time, it indicated that less than 24 hours passed from when the plenary session approved assuming the service and taking possession of it.

The company responsible for the water service since 2013 has pointed out that "this very short period" would have prevented it from "carrying out, with due guarantees, essential tasks such as inventory verification, checking the condition of assets, or the correct organization of the operational transition."

In addition, it has pointed out that this action affects "directly" "critical infrastructures, computer systems, databases, contracts, economic documentation, labor relations, and other essential assets, whose ownership, impact, reversibility, and legal regime have not been duly delimited."

 

Delivery of assets, facilities, and documentation, under protest

The company has assured that it has made it clear that "any delivery of assets, facilities, or documentation" to the Water Consortium "is being carried out under express protest and with full reservation of rights." At the same time, it has insisted that, "in no way," does it imply acceptance of the legality of the service intervention nor that it recognizes any "breach of contract."

Thus, it has indicated that "it is impossible to understand the legal framework that supports the act of appropriation." Furthermore, it has expressly requested "that no material action be taken without the presence of its representatives."

To conclude, Canal Gestión Lanzarote has insisted that it reserves the right to exercise "as many legal actions as may correspond to it" in response to the decisions to terminate the contract and take possession of the service.
