The Agency for the Protection of the Urban and Natural Environment (Apmun) has initiated a sanctioning procedure against an entity in Lanzarote, which faces a fine of more than 60,000 euros for violating the Waste Law of the Canary Islands. This resolution, published this Monday in the Official Gazette of the Canary Islands (BOC), is dated May 23.
The company is allegedly responsible for the commission of three infractions of the Waste Law of the Canary Islands. Specifically, Apmun considers that the company should receive a sanction of 30,000 euros for a serious infraction in the uncontrolled dumping of non-hazardous waste, such as vegetable oils.
In addition, it imposes another sanction of 30,000 euros for "the exercise of a waste management activity of storage of used tires without the required authorization." In this case, and as a provisional measure, it orders the suspension of the activity in regards to the storage of used tires, in these facilities located on Codornices Street, in Nazaret (Teguise).
Apmun also considers that this company is responsible for a minor administrative infraction of the Waste Law of the Canary Islands for which the registry of small producers of toxic and hazardous waste is regulated. In this case, the Agency assures that a sanction of 3,155 euros is applicable.
The Agency has also required the affected company to correct the illegal situation created as a consequence of the alleged commission of these infractions within a period of one month. In this sense, it orders that hazardous waste be stored in accordance with regulations, that the distinctive plaque of a small waste producer be placed in a visible place, and that the dumped vegetable waste be removed and delivered to an authorized manager.
The company now has a period of 15 days to present allegations. If no allegations are presented, the agreement to initiate this sanctioning procedure may be considered a proposed resolution. The maximum period to resolve this file is six months, otherwise it will expire, as stated in the Official Gazette of the Canary Islands.
Another sanction of 6,000 euros
On the other hand, Apmun has also notified through the BOC a proposed resolution against another person for violating the Waste Law of the Canary Islands. In this case, the sanction is 6,012.10 euros for the abandonment and dumping of non-hazardous waste such as rubble in the open, on the road of Invernadero Street, which passes through the back of the Arrecife cemetery.
Apmun has required the defendant to regulate their activity through the correct management of waste with its delivery to an authorized manager. The defendant also has a period of 15 days to present allegations.
