UGT will sue Adislan for considering the dismissals of a dozen workers "null or improper"

UGT will sue the Association of People with Disabilities of Lanzarote (Adislan) for considering the dismissals of a dozen employees "null or improper" "We are going to file the corresponding lawsuit against the company, because we understand that the rights of the workers have been violated," announced the general secretary of UGT on the island, César Reyes, on Radio Lanzarote-Onda Cero.

"They didn't want to do an ERTE, they fired us, and on top of that they don't even give us compensation," denounced one of those affected a week ago, who stated that there were eleven other colleagues who had been fired. "We feel defrauded, because they asked us for tact and empathy with the users and they have not had it with us," he added.

As he told La Voz, all those dismissed were workers "from different departments" of the day center who, after its closure due to the state of alarm, were relocated "to provide support in the residence and in the homes" of the association, to later dismiss them.

In his case, it was on March 31 when Adislan informed him of the dismissal, alleging that the association had been "continuously with economic losses for years" and that for this reason it had decided to proceed "to its objective dismissal" without paying him the compensation that would correspond to him.

And it is that, in the dismissal letter, Adislan stated that in 2015 it had losses of 11,894 euros, which in 2016 skyrocketed to 174,022 euros, reducing to 135,526 euros in 2017. Regarding 2018, the association acknowledged having closed "with a positive" of 133,631 euros, but attributed it to "a one-off income of 250,000 euros" that accommodated the result, ensuring that in 2019 it reached losses "for the value of 342,898.23 euros".

Faced with this, and considering that in this way Adislan was failing to comply with the Government's decree, which temporarily prohibited, until the health crisis ends, dismissals due to force majeure or objective causes that are justified by the impact of the coronavirus, those affected contacted UGT from where, after having studied the documentation, they have confirmed that they will file a lawsuit against Adislan.
