Twelve years in prison, a restraining order for 20 years and compensation for damages of 10,000 euros. This is the Prosecutor's Office request for a man accused of sexually assaulting his ex-partner, when they were in the process of divorce. The trial, which is being conducted by the Second Section of the Provincial Court, is scheduled to be held next Tuesday morning in Arrecife.
This man, of Spanish nationality, initials J.M.B.C. and 57 years old, has been subject to a restraining order from his ex-wife since April 12, 2012. The day before, according to the Prosecutor's Office's indictment, he had beaten and raped his ex-partner. The prosecutor's account explains that the accused was waiting for her at 8:20 a.m., when she was taking their youngest son to school in Arrecife. He then invited her to his home, "to talk about their divorce, to which his ex-partner agreed."
However, when he opened the door of the house, "he grabbed her hands tightly, dragging her towards the bedroom and once inside he pushed her onto the bed, taking advantage of that moment to lock the bedroom and hide it." At that moment, the writing continues, "he lowered his pants" and took off her clothes "by force", "until he completely undressed her."
After stripping her of her clothes, "he began to hit her on the thighs, waist and buttocks while saying 'you are going to be my slave'." She tried to "break free", but failed. And he, "far from abandoning his purpose, forced her to perform oral sex despite her refusal." The aggression did not stop there and afterwards, according to the Prosecutor's Office, he "penetrated her vaginally without any type of protection while she cried."
As a result of that aggression, the woman suffered various injuries to her lower abdomen, buttocks and left thigh. The prosecutor considers that these acts constitute a crime of sexual assault, for which he is asking for J.M.B.C. 12 years in prison and a prohibition from approaching, for 20 years, less than 500 meters from the victim's place of work, home or any place where she is, as well as from communicating with her "by any means." He also requests compensation of 10,000 euros for moral damages and that, if he is convicted, the protection measures be maintained until the sentence is final.
