Former Real Madrid youth players Ferrán Ruiz, Juan Rodríguez, and Andrés García have accepted a sentence of one year in prison for child pornography for the sex video they recorded in 2023 in Gran Canaria, while first-team defender Raúl Asencio has been acquitted for disseminating the video.
The sentence has been firmly agreed upon by all prosecution and defense parties after the two young women appearing in the images, one of whom was 16 years old at the time, confirmed in court that they have forgiven the four players "of their own free will" and "so that this ends," as they assured prosecutor Mercedes Gil this Thursday.
Their forgiveness nullifies the only charge Raúl Asencio faced (disclosure of secrets: having shown a third party the video sent to him by the other defendants, knowing it was recorded without the complainants' permission) and has led the Prosecution to agree to apply a mitigating factor to the most serious crime imputed to his three former teammates, that of child pornography.
Before this agreed-upon sentence was finalized, the Public Prosecutor's Office was seeking four years and seven months in prison for Ferrán Ruiz, Juan Rodríguez, and Andrés García, and two and a half years for Raúl Asencio, who has apologized to the victims and thanked them for their forgiveness, something all defendants have also done, except for Andrés.
At the request of the defense, the Prosecution has agreed to suspend the one-year prison sentence imposed on Ferrán, Juan, and Andrés, in exchange for them not committing any offenses in the next two years and undergoing a sexual awareness course.
To make this decision, magistrate Virginia Peña took into account their "personal and social circumstances," the fact that they have no prior criminal record, and "the effort they have made to repair the damage caused."
Both the prosecutor and the magistrate explained that they deserve this suspension in accordance with the Penal Code for prison sentences of less than two years.
Asencio has also been acquitted of paying costs, which the other three defendants will have to pay. They have been issued a two-year restraining order from the victim who was 16 years old when the events occurred and a three-year disqualification from practicing any profession or trade that involves contact with minors.
