The three defendants accused of "providing" narcotics in a Playa Blanca establishment have reached a compliance agreement with the Prosecutor's Office and have accepted a sentence of 3 years and 3 months in prison. The Provincial Court of Las Palmas was going to try these three people this Tuesday in the Courts of Arrecife, but finally the defendants have accepted the modification made by the prosecutor, who has gone from asking for 7 years in prison for each of them to 3 years and 3 months, thus avoiding the holding of the oral hearing.

The events for which this sentence has been imposed occurred in 2011 in a bar in Playa Blanca. According to the Prosecutor's qualification brief, one of the defendants, Primitivo San Juan Rodríguez Hernández, with no criminal record, runs the Malvasía bar-restaurant, located on Comederos street in the tourist town.

In this bar, he had another of the defendants, Tawfir Rodaine, as an employee, who worked as a waiter and also had no criminal record. Occasionally, he also employed another defendant, Youssef Tayibi. "Acting in prior and mutual agreement, from an undetermined date but in any case until April 20, 2011, with total disregard for collective health, they provided narcotics inside the establishment and during opening hours to the public to third parties", according to the prosecutor.

Money, "from the sale" of drugs


Tawfir Rodaine's home in Playa Blanca was seized with 14.47 grams of cocaine with an average purity of 19.77 percent, which would have reached a value of 383.33 euros on the illicit market, and 680 euros in the same cash box, in which he deposited said substance. They also found 53.65 euros, which he was carrying at that time, "from the sale of narcotics."

As the Prosecutor's Office explains in its indictment, the defendant Youssef Tayibi was seized in the vicinity of the bar with a precision scale and 3.68 grams of cocaine, with an average purity of 18.94 percent, which would have reached a value of 93.60 euros on the illicit market.

Given these facts, the Prosecutor's Office requested seven years in prison for each defendant, but has finally reached an agreement with the three, who have accepted a sentence of three years and three months in prison. In addition, they must pay a fine of 1,907 euros and, if they do not, they will be imposed two more months of deprivation of liberty. The defendants have had their passports returned after accepting the facts and the sentence.
