An arrest for alleged trespassing, assault and animal abuse ends with a 60 euro fine

​The sentence has only considered proven that the accused hit another man in the face and neck, but outside the house. For the injuries, he is ordered to pay compensation of 245 euros.

A German who was arrested in July 2019 in Arrecife as alleged perpetrator of the crimes of trespassing, assault and animal abuse, for having hit both the owner of a house and his dog, has ended up being sentenced only to pay a fine of 60 euros for a minor crime of injury, as well as to compensate the victim with 245 euros for damages.

The sentence, issued on September 18 by the Court of Instruction Number 3 of Arrecife, indicates that the aggression occurred in the street and does not consider it proven that the dog was present, nor that the wounds presented by the animal had been caused by the accused. As for the crime of trespassing, it finally did not even go to trial.

Thus, of the two crimes for which the Prosecutor's Office filed charges - one minor for injuries and another minor for animal abuse - he has only been convicted of one, and with a penalty lower than that requested by the Public Prosecutor's Office, which was 420 euros fine for injuries (in addition to another 360 euros for animal abuse). It should be noted that the Penal Code only contemplates fines - and not prison sentences - when the injuries caused do not require medical or surgical treatment after the first health evaluation.
