The First Section of the Provincial Court of Las Palmas will try next Wednesday in Arrecife the president and secretary of the Weed Apothecary Cannabis Association of Lanzarote accused of a crime against public health and another of illicit association.
According to the Prosecutor's Office, the events date back to February 2016, when the accused C.G. assumed the position of president and N.J. that of secretary. In its Statutes, the association established that they would develop a project to "reduce the risk associated with cannabis use." In addition to complying with the advice of the Supreme Court, which determined impunity for consumers who shared products in a space as long as there was no risk that third parties would make "an indiscriminate use" of their consumption.
According to the Public Prosecutor's Office, the accused allegedly obtained hashish and marijuana from different suppliers without having "any administrative authorization" for the production and distribution of marijuana, nor having requested a license from the Spanish Agency for Medicines and Health Products.
The Public Prosecutor defends that "since they assumed the positions" the accused allegedly intended to allow "access to substances that cause damage to health to an indiscriminate plurality of people." To access the association, "any person who was a consumer of cannabinoids or had been diagnosed with a disease so that the therapeutic or palliative use of cannabinoids has been scientifically proven" could do so.
This association came to have 1,501 members. However, the Public Prosecutor's Office argues that "none of the association's rules" contemplated that the consumption of cannabis was shared among the members, nor that "they could obtain cannabis, nor a maximum withdrawal limit."
In this line, he states that "with total disregard for the health of others", both allegedly used the association for the purpose of selling and distributing marijuana and hashish to third parties in exchange for money. Thus, he points out different sales on April 7, 13 and 14, 2018, as well as on February 1, 2019.
On March 14, 2019, the entry and search of the commercial premises took place. In that registry a precision scale, a book of members, 2,377, 18 euros in cash and various amounts of hashish, cannabis resin and marijuana distributed in small containers, jars and bags were found.
In total, the substances found amount to 47.07 grams of hashish worth 256 euros, 11.7 grams of hashish oil worth 157 euros and 3,070 grams of marijuana worth 15,477 euros.
The Prosecutor's Office attributes to them the authorship of a crime against public health and another of illicit association. In addition, it asks for the president of the cannabis club the prison sentence of three years for a crime against public health, a fine of 31,783 euros, with subsidiary civil liability and special disqualification for passive suffrage. In addition to four years of prison for the crime of illicit association and ten years of disqualification for employment or public office, plus the penalty of a fine of 24 months with a quota of 12 euros of subsidiary responsibility.
While for the secretary requests the prison sentence of three years for a crime against public health, a fine of 31,783 euros, with subsidiary civil liability and special disqualification for passive suffrage. In addition to three years of prison for the crime of association illicit and the penalty of a fine of 24 months with a quota of 12 euros of subsidiary responsibility.
In addition, the Public Prosecutor's Office concludes by requesting the dissolution of the alleged illicit association. In addition to the confiscation of the seized drugs and money.
