The Prosecutor's Office has requested a prison sentence of two and a half years against the former PSOE deputy Juan Bernardo Fuentes Curbelo in a separate piece of the Mediator case, whom it accuses of facilitating a fraudulent work contract to a Moroccan citizen who needed it to obtain residency in Spain.
In this piece, the prosecution requests the same prison sentence for the Moroccan citizen Rachid Z., for Domingo José F.G., son of the former socialist deputy, and for María Jesús R.V., administrator and co-owner along with Fuentes Curbelo of the commercial entity Ganadería Tetir, through which the work contract was formalized.
All four are attributed with crimes of falsification of an official document and against Social Security.
The Prosecutor's Office also requests that the four defendants jointly and severally indemnify the State Public Employment Service with 2,184 euros plus interest for the unemployment benefit that Rachid Z. obtained after the termination of the allegedly fictitious work contract.
According to the indictment filed with the Investigating Court number 4 of Santa Cruz de Tenerife, to which EFE has had access, Rachid Z., a former employee of Fuentes Curbelo at Ganadería Tetir, needed to prove an employment relationship to comply with the requirements of the Immigration Law to obtain residency in Spain.
He asked Fuentes Curbelo to register him as employed for a period of three months so that he would fictitiously appear as an employee of the livestock farm, although he would contribute the corresponding Social Security contributions.
The Prosecutor's Office points out that Fuentes Curbelo contacted his son, Domingo José F.R., attorney and representative of Gestoría Tetir, an entity in charge of managing the family's various companies, to ask him to prepare the fictitious contract.
The contract was given to María Jesús R.V., administrator and 50% owner of Ganadaría Tetir together with Fuentes Curbelo, who authorized the processing of the documentation "knowing its falsity", according to the accusation.
Asesoría Tetir, headed by Domingo José F.G., was in charge of completing the processing of the contracting file.
In that contract, Rachid Z. appeared as a livestock farmhand on a full-time basis of 40 hours per week from December 15, 2020 to March 14, 2021, a period that allowed him to complete the cycle required to obtain the renewal of the residency documentation and access unemployment benefits.
In view of this contract, on January 4, 2021, the Sub-delegation of the Government in Las Palmas authorized the temporary residence and work permit of the accused.
The Moroccan citizen also obtained 2,184.27 euros in unemployment benefits between March 14 and August 8, 2021, thanks to the three months of Social Security contributions provided by Ganadería Tetir, money that he actually contributed himself, according to the accusation.
