The trial against the accused of abusing a woman "taking advantage" of the fact that she had consumed drugs, which the First Section of the Provincial Court was going to hold this Thursday in Arrecife, has been suspended as the defendant is "at an unknown location", as confirmed by the court. Thus, a new date will have to be set once the accused is located.
The events, according to the indictment of the Public Prosecutor's Office, took place on October 7, 2016 in a house in Tahíche at around 7 a.m. There, "acting with libidinous and lascivious intent", the accused "entered the room" in which the victim "was sleeping" and "vaginally penetrated her, taking advantage of the fact that she was under the influence of narcotic substances that annulled her will after having consumed cannabis, which led her to believe that it was with her boyfriend with whom she was having relations, causing serious moral damage", according to the Prosecutor's Office.
The Public Prosecutor's Office considers that the events constitute a crime of non-consensual sexual abuse and, therefore, is asking for a sentence of eight years in prison for the accused, as well as compensation to the victim in the amount of 6,000 euros "for the moral damages caused". It is also requested that he be prohibited from approaching the woman "at a distance of less than 300 meters" for a period of 13 years and, if convicted, that he be placed on supervised release for seven years, once he leaves prison.
