On the night of January 6, 2010, two people broke into a house in Uga, owned by Sixto Calero Medina, who was 76 years old and died that day of a heart attack. Twelve and a half years later, one of the assailants will finally enter prison to serve a one-year prison sentence.
The sentence was handed down in May 2021, but it was not even executed, as it did not exceed two years. However, Criminal Court Number 3 of Arrecife has now revoked that decision, as the convicted person has committed a new crime during this time.
Along with José Miguel Canto Rodríguez, who is the one who will now enter Tahíche, Nurby Silena Gómez González was convicted in the case, both for a crime of robbery with force. The trial did not even take place, since on the day set for the hearing, both confessed to the facts and accepted a settlement agreement, which meant a reduction in the sentence.
In addition, the Prosecutor's Office also reduced its initial request by applying as a mitigating factor the “undue delays” suffered by the processing of this case, which fell to the Investigating Court Number 3 of Arrecife, then in charge of the controversial judge Rafael Lis.
“The present procedure has been paralyzed for at least four years”, the Prosecutor's Office stated when modifying its conclusions on the day of the trial, thus reducing the request for conviction for those undue delays. The proceedings began in July 2010, a few months after the event, and the investigation did not end until 2019.

According to the sentence and the defendants' confession, both accessed the house through the back door, forcing the lock. Once inside, they went to the bedroom and opened several drawers, stealing various objects, including a mobile phone.
The next day, one of Sixto Calero's sons went to the house and found the door open, “everything a bit messy” and his father “lying on the floor”. As he approached, he discovered that he had died.
Initially, the Civil Guard investigated whether it could have been a crime, but the autopsy later confirmed that the death was due to a heart attack. “He died of natural causes”, stated the sentence issued just over a year ago, which only convicted the defendants of a crime of robbery with force.
As the sentence was less than one year in prison, the defenses requested that the execution be suspended, and the Public Prosecutor's Office reported favorably. The magistrate agreed to this benefit, conditioned on them not committing any crime during the suspension period of the prison sentence, established in two years.
However, a few months ago the Court requested the updated criminal record of José Miguel Canto Rodríguez, “resulting in him having been convicted again during the suspension period”. This is stated in an order issued on June 6, which orders the revocation of that benefit, decreeing his entry into prison.
