The Sixth Section of the Provincial Court of Las Palmas will try next March 9 in Arrecife a defendant accused of sexually assaulting a 15 year-old minor at the Deiland Shopping Center, in Playa Honda. The alleged aggressor has been since the date of the events in provisional detention.
The events date back to December 18, 2024, when the accused N.B.T. crossed paths with the victim at one of the access doors to the said shopping center. At that moment, the alleged aggressor touched the minor's genital area over her pants.
After that, the victim called her relatives to tell them what had happened, so they went to the place. Once there, the accused approached them touching his genitals over his pants and taking out his penis, showing it to several of its members, including the minor and her younger brother. Due to these events, the minor suffered an acute stress disorder with an evolutionary course of 30 days.
Therefore, the Prosecutor's Office accuses the alleged aggressor of a crime of sexual assault on a minor under 16 years of age and another of exhibitionism. For the crime of sexual assault, it requests for him a prison sentence of four years and nine months, as well as special disqualification from the right to passive suffrage for the duration of the sentence, while for the crime of exhibitionism it requests nine months of prison and also the prohibition from exercising the right to vote during that time. An agreement will foreseeably be reached between the Prosecutor's Office and the defense of the accusation to avoid the trial.
In addition, it also requests the prohibition from approaching within 300 meters of the minor, her home or places she frequents for a period of eight years. Likewise, it requests for the accused eight years of supervised release once he completes the prison sentence and must attend a sexual education course on a mandatory basis.
The Public Prosecutor's Office also requests the special disqualification from exercising parental authority rights, guardianship, curatorship, custody or foster care, for a period of seven years, and the special disqualification from any profession, trade or activities that involve regular and direct contact with minors for a period of 15 years.
Finally, the accused shall compensate the victim's legal representatives with 1,200 euros for psychological injuries and 6,000 euros for the moral damages caused.
