The TSJC ratifies extending the limitation of people in social gatherings by alert levels

It considers that it is a "proportionate measure" in defense of public health and "scarcely invasive" with individual freedoms

The Contentious-Administrative Chamber, second section, of the Superior Court of Justice of the Canary Islands (TSJC), has ratified the extension of the limitation of the number of non-cohabiting people in social and family gatherings according to the level of epidemiological alert.

Thus, on islands with level 1 there will be a maximum of 10 people, on level 2 six people and on levels 3 and 4 a total of four people maximum, and the limit will never be exceeded even if there are cohabitants and non-cohabitants.

The measure, against which an appeal may be filed, remains in effect until 00:00 on September 30.

The order, made public this Thursday, considers that the limitation of people is a "proportionate measure" in defense of public health and does not restrict the fundamental rights of citizens, but rather modulates them but does not prevent them.

The chamber values ​​that the Government requests a "scarcely invasive" measure with individual freedoms and with a limited validity in time, but warns the Executive that if in the future it takes more restrictive measures it must submit them to judicial ratification.
