The TSJC lifts the measure that suspended the tourist tax in Mogán

The Court had suspended in a "very provisional" manner the tax approved by the southern council, at the request of the Federation of Hospitality and Tourism Businessmen of Las Palmas

The First Section of the Administrative Litigation Chamber of the Superior Court of Justice of the Canary Islands has lifted the precautionary measure that had suspended in a "very provisional" manner the tourist tax of Mogán, one of the most touristy municipalities in the Canary Islands, on March 12, just one day after its entry into force. This is reflected in an order of this past March 20.

On March 10, the procedural representation of the Federation of Hospitality and Tourism Businessmen of Las Palmas (FETH) filed an administrative litigation appeal against the fiscal ordinance approved by the Gran Canaria council that imposes a tax of 0.15 cents per night and person on tourist overnight stays. Thus, the Federation requested the precautionary suspension even before giving the council a hearing.

The FETH stated that the council "committed innumerable irregularities", with "terms that it considers confusing, unintelligible" and that could turn the "adequate collection of the tax into an impossible task."

Thus, in this new resolution, the Superior Court of Justice points out that "there are no reasons of special urgency" and neither "have innumerable irregularities been committed" as denounced by the business association. "The collection of the tax is very simple, not at all complex, without an excessive effort, it does not require information and documentation tasks that are very difficult to comply with," the judicial order concluded.
