The Contentious Chamber of the High Court of Justice of the Canary Islands (TSJC) has rejected the health measure against the spread of Covid-19 agreed by the Minister of Health of the Government of the Canary Islands on December 28. This is a measure that intended to restrict night travel on the night of December 31 to January 1, from January 1 to 2, and from January 5 to 6 of the same month (between 01:00 hours and 06:00 hours in the Islands at level 3 and 4; and between 02:00 hours and 06:00 hours in the Islands at level 2).
In an order notified this Thursday, the Second Section of the Contentious-Administrative Chamber of the TSJC at its headquarters in Las Palmas, formed by the magistrates María Mercedes Martín Olivera (rapporteur), Lucía Déborah Padilla Ramos and the magistrate Antonio Doreste Armas, considers that the measure does not meet the indicators of suitability, necessity and weighting. It points out, in this regard, that "it is excessive and generates serious damage for the generality of the people."
Therefore, the Chamber resolves "not to authorize the health measure agreed by the Order of the Minister of Health."
An appeal for cassation may be lodged with the Supreme Court within three days.
